The Paris Agreement represents one of the most significant achievements in international climate diplomacy. Adopted in December 2015 and entering into force in November 2016, this landmark treaty has reshaped how nations approach climate change collectively. For India-the world’s third-largest greenhouse gas emitter and home to over 1.3 billion people-the Agreement carries profound implications for its development trajectory, energy policies, and commitments to protecting vulnerable populations. Understanding its legal framework, core components, and India’s specific obligations is essential for anyone studying climate governance.

The Paris Agreement qualifies as a treaty under the Vienna Convention on the Law of Treaties, making it a legally binding international instrument. This classification follows from the Vienna Convention’s definition of a treaty as an international agreement concluded between states in written form and governed by international law. However, what makes the Paris Agreement distinctive is its hybrid legal structure-while the agreement itself is legally binding, not all its component provisions create equal legal obligations.

Unlike the Kyoto Protocol, which created sharp divisions between developed and developing nations with its top-down emission reduction targets, the Paris Agreement employs a bottom-up approach. States set their own climate targets rather than having them negotiated at the international level. This design choice was intentional-it allowed broader participation while accommodating different national circumstances and development priorities.

As of today, 195 parties (194 states plus the European Union) have joined the Paris Agreement, demonstrating near-universal acceptance of its framework. India ratified the Agreement on October 2, 2016, reinforcing its commitment to multilateral climate action while preserving its stance on differentiated responsibilities between developed and developing nations.

Core components and temperature goals

The Paris Agreement establishes ambitious long-term goals that guide global climate action. Its central objective is to hold the increase in global average temperature to well below 2°C above pre-industrial levels while pursuing efforts to limit it to 1.5°C. Scientists have determined that limiting warming to 1.5°C would significantly reduce climate risks compared to 2°C, though both thresholds present serious challenges.

Nationally Determined Contributions (NDCs)

The Agreement operates through Nationally Determined Contributions (NDCs), which serve as the primary vehicle for countries to communicate their climate targets and actions. These national plans form the foundation of the Paris Agreement and must be updated every five years. Each successive NDC must demonstrate progression beyond the previous one, reflecting the “ratchet mechanism” designed to increase ambition over time.

The global stocktake

A critical innovation of the Paris Agreement is the global stocktake mechanism. This process assesses collective progress towards achieving the Agreement’s temperature goals and long-term objectives. The first global stocktake concluded at COP28 in 2023, calling on governments to accelerate the transition away from fossil fuels toward renewable energy sources. These assessments provide crucial feedback for countries to enhance their climate commitments.

Enhanced Transparency Framework

Transparency forms the backbone of the Paris Agreement’s accountability system. Parties must report regularly on their progress in implementing their NDC targets, and these reports are subject to international peer review. From 2024 onwards, all parties must submit Biennial Transparency Reports (BTRs) every two years. This framework creates the basis for the global public to assess which states have met their climate commitments and which have fallen short.

Compliance mechanism

Article 15 of the Paris Agreement establishes a mechanism to facilitate implementation and promote compliance. This committee was designed to be facilitative rather than punitive-it can assist parties in engaging with finance and technology bodies, recommend action plans, and issue findings of fact. The mechanism deliberately lacks enforcement teeth, reflecting the compromise between parties wanting strong compliance rules and those preferring a voluntary approach.

Human rights dimension

In a significant departure from earlier climate instruments, the Paris Agreement explicitly acknowledges the relationship between climate change and human rights. The Agreement’s preamble calls on states to respect, promote and consider their human rights obligations when taking climate action. This includes rights related to health, indigenous peoples, local communities, migrants, children, persons with disabilities, and people in vulnerable situations.

This marked the first reference to human rights in any multilateral environmental agreement, representing an important step toward ensuring that climate policies protect rather than harm vulnerable populations. Under human rights law, states have obligations to protect those whose rights are affected by climate change, with priority given to the most vulnerable groups.

The human rights framework requires that states develop national climate policies through transparent processes that promote effective participation of all affected communities. The UN High Commissioner for Human Rights has emphasized that climate change is eroding fundamental rights, especially for the most vulnerable. This recognition demands that climate adaptation actions prioritize the needs of vulnerable populations, including small-scale food producers, indigenous communities, and those in climate-sensitive regions.

India’s obligations under the Agreement

India’s engagement with the Paris Agreement reflects its unique position as a major developing economy with significant climate vulnerabilities. India’s updated NDC has been prepared considering national circumstances and the principle of common but differentiated responsibilities and respective capabilities (CBDR-RC)-a foundational concept that acknowledges developed nations’ greater historical responsibility for climate change.

India’s NDC commitments

India’s climate targets have evolved significantly since the Agreement’s adoption. India’s original 2015 NDC included three main targets for 2030: reducing emissions intensity of GDP by 33-35% from 2005 levels, achieving 40% of electricity capacity from non-fossil sources, and creating an additional carbon sink of 2.5 to 3 billion tonnes of CO2 equivalent through forest and tree cover.

At COP26 in Glasgow, Prime Minister Modi announced “Panchamrit”-five climate commitments that strengthened India’s ambitions. India’s updated 2022 NDC commits to reducing emissions intensity by 45% by 2030 from 2005 levels and achieving 50% cumulative electric power capacity from non-fossil sources by 2030. Additionally, India pledged to reach net-zero emissions by 2070.

Progress on targets

India has made remarkable progress on several commitments. India achieved its non-fossil fuel capacity target in 2024-five years ahead of schedule-with approximately 50% of its total installed capacity coming from non-fossil sources. This includes solar, wind, hydro, and nuclear energy. As of 2023, India’s emissions intensity had already decreased by 33% compared to 2005, meeting its original target well before the 2030 deadline.

However, independent assessments suggest that India’s current targets and policies remain insufficient for achieving the Paris Agreement’s 1.5°C temperature limit. While India has demonstrated strong progress in renewable energy deployment, continued reliance on coal power presents challenges for deeper decarbonization.

Reporting and transparency requirements

Under the Paris Agreement, India must periodically report on actions taken to implement its contributions. All parties must report a national greenhouse gas inventory and information necessary to track progress toward their NDC. Developing country parties should also report on support needed and received for climate action.

The transparency framework requires rigorous quantitative data collection to demonstrate progress. India’s third national communication to the UNFCCC, submitted in December 2023, provided evidence of emissions intensity reductions and progress on renewable energy deployment. These reports feed into the global stocktake process and inform subsequent rounds of NDC submissions.

Long-term strategy and future outlook

The Paris Agreement invites countries to formulate long-term low greenhouse gas development strategies, though unlike NDCs, these are not mandatory. India’s 2070 net-zero target provides a long-term vision, but implementing policies must balance climate ambitions with development priorities including poverty alleviation, energy access, and economic growth.

India requires approximately USD 2.5 trillion in financing to meet its existing NDC targets through 2030. The country has consistently emphasized that developed nations must fulfill their commitments to provide climate finance and technology transfer to support developing countries’ climate action. This position reflects the CBDR-RC principle enshrined in both the UNFCCC and Paris Agreement.

The path forward

The Paris Agreement has fundamentally transformed international climate governance by creating a framework that accommodates diverse national circumstances while pushing for collective ambition. Transparency efforts help shape evidence-based national policies and support the global stocktake process, creating a continuous cycle of assessment and increased ambition.

For India, the Agreement presents both challenges and opportunities. The country’s rapid renewable energy deployment demonstrates that economic development and climate action can proceed together. India’s updated NDC captures a citizen-centric approach to climate change through the LIFE (Lifestyle for Environment) movement, emphasizing sustainable lifestyles alongside technological solutions.

Yet significant gaps remain. The global community is not on track to limit warming to 1.5°C, and all countries-including India-face pressure to enhance their commitments. The next round of NDCs due in 2025 will set emissions reduction targets through 2035, representing a crucial opportunity to align short-term actions with long-term climate goals.
